A three-judge bench of the Court of Appeal has temporarily barred Adul from presiding over House business in the Kisumu County Assembly, pending the hearing of the case on March 3.

This is after members of the assembly moved to the court last week, asking the court to review a decision by the Employment and Labour Relations Court to reinstate Adul, who they impeached last October.

The case was to be heard today (Thursday), but the Bench said they had a huge list of cases to attend to.

After time given to the parties to reach an agreement failed, the judges said the decision by Lady Justice Hellen Wasilwa should be halted until the next hearing.

The three appellate judges are Justices Sankale ole Kantai, William Ouko and David Maraga.

The MCAs argue in their appeal that Justice Wasilwa reinstated Adul despite more than three quarters of the house having voted for her impeachment.

Through their lawyers Paul Muite and Okong’o Omogeni, the members said Adul should be barred from presiding over house business.

However, Ken Okong’o, representing the Speaker, objected the requests, saying it will amount to infringement of Adul’s rights.

According to Okong’o, granting the requests by the Assembly would also go against the decision by the Industrial.

Following the court ruling, speaker’s panel is set to assume the running of the Assembly business.
