An Employment and Labour Relations court sitting in Kisumu has given a go ahead to Nyamira County Governor John Nyagarama to recruit employee but in exception of eight Chief Officers and County Secretary.
Through Achoki and company Advocates, Vincent Omao, the petitioner, had argued that Chief Officers were under contract so as the County Secretary.
“The county government can proceed with advertisements and recruitment on condition that eight (8) Chief Officers and County Secretary positions are not affected,” read part of November 29th ruling by Justice Maureen Onyango.
It further read: “The County government not to terminate the employment contracts of Chief Officers and County secretary without due process.”
Upon assuming his second term, Nyagarama had declared the Chief Officers positions vacant with County Secretary Erick Onchana sent for a compulsory leave.
The order consequently, means that should Nyagarama send the officials packing, he ought to adhere to contractual agreements upon their recruitment.
