Senior principal magistrate Felix Kombo on Wednesday ruled that testimonies by various witnesses had failed to link Gitongah to the bribery claims.

“The state had failed to provide convincing evidence to link Mr Gitongah to the bribery allegations,” said Kombo during the ruling.

He added: “The court finds the accused not guilty and hereby acquit him.”

Gitongah was accused that on February 21, 2011, being the district officer 1 at Namanga and being a person employed in the public service, he improperly solicited for a bribe of Sh8,000 before releasing parts of a vehicle allegedly confiscated from one Ms Hannah Waithera, a local business woman.

The businesswoman was said to have been transporting charcoal allegedly without a permit.

Senior detectives from the Ethics and Anti-corruption Commission and the businesswoman testified during the trial.
