The High Court has barred Director of Public Prosecutions (DPP) and Director of Criminal Investigations (DCI) from investigating Wavinya Ndeti’s lawyer Ham Lagat over an affidavit. The lawyer found himself in hot soup after he commissioned an affidavit in a case challenging reelection of Machakos governor Dr. Alfred Mutua.
“For the avoidance of doubts, the respondent be restrained from taking further proceedings, sharing the results of any investigations or prosecuting the applicant before any forum until 24th of January this year,” ruled Aburili
Judge Roselyn Aburili gave the order after Wavinya’s lawyer alleged that the police stormed his Kileleshwa home threatening his family.
Lagat refuted claims that he wrote any letter to Mutua’s lawyer disowning the affidavits used in the Wavinya-Mutua case.
Mutua defended his seat using Maendeleo Chap Chap (MCC) party while Wavinya Ndeti used the Wiper party ticket.
Mutua won but Wavinya moved to court on the grounds of rampant electoral malpractices including allegations of using county staff as poll officials.
