The High Court has declined to stop prosecution of former Devolution and Planning Principal Secretary, Eng Peter Mangiti, dealing him a major blow.

Dismissing the application, Tuesday, Anti-Corruption Court Justice Hedwig Ong'udi said it is beyond her jurisdiction to rule in favour of Mangiti's request, and asked him to file his evidence and facts at the trial court.

She said Mangiti did not show evidence that the Office of the Director of Public Prosecution (ODPP) and the Ethics and Anti-Corruption Commission (EACC) acted without jurisdiction, by opening corruption file against him.

Mangiti is among other 15 suspects in the Sh1.8 billion NYS scandal, that saw former Cabinet Secretary Anne Waiguru and the Director of Youth Service, Nelson Githinji, resign from office, for investigations.

On November 18, 2016, he was first charged with conspiracy to steal Sh695 million, from the NYS kitty.
