[Photo|Keffah Wesley]The High Court has ordered for a recount of votes in the August 8 general elections, in an election petition against Nyamira Governor John Nyagarama. The Court on Monday, directed that votes in 90 out of the 533 polling stations in Nyamira County, be recounted, following a petition by former area gubernatorial candidate for Jubilee Party, Walter Nyambati. He came second by garnering 58,936 votes against Nyagarama’s 63,949, but moved to court citing massive irregularities and illegalities in the election. In the petition, Nyambati accused County Returning officer David Towett of recruiting eight Nyamira County employees as returning officers, who later rigged the election in favour of Nyagarama of NASA coalition's ODM party. In the directive, Presiding Judge James Makau said that he was satisfied with the evidence provided by several of Nyambati's witnesses. He said recount of votes should be completed by December 17 and results presented to the court so as to make final judgment.IEBC lawyer Gilbert Nyamweya and Governor Nyagarama’s lawyer Erastus Orina vowed to challenge the ruling.“We plead to the court to grant the defendants certified copies of this ruling. We want to make an application over the ruling,” Orina told the court.
