The Mombasa High Court has rejected an application by the prosecution to have the widow of slain Muslim cleric Sheikh Aboud Rogo detained in police custody and her bail canceled.
The prosecution appealed the ruling by Mombasa principal magistrate Diana Mochache, who had freed Ms Haniya Saggar on a Sh1 million cash bond.
Lady Justice Dora Chepkwony ruled on Tuesday that she had not found sufficient reason to interfere with the ruling that granted Ms Saggar bond.
Justice Chepkwony said in her ruling that the magistrate exercised discretion on the matter and that the prosecution had not given a good reason against the decision.
According to Baraka FM, Judge Chepkwony gave the state counsel seven days to appeal the decision failure to which Saggar would be released.
Ms Saggar was taken to court to answer to charges of holding crucial information that would have helped the police avert the botched terror attack on the Mombasa Central Police Station on September 11, 2016.
She was charged together with three other women, Luul Ali, Nasteho Ali and Zamzam Abdallahi, for allegedly conspiring to carry out an attack at the police station.
