The High Court has dismissed an application filed by the civil society seeking to halt a Sh200 billion housing project launched by Mombasa Governor Hassan Joho.
The civil society, led by Annette Mudola Mbogoli, argued that the county government had failed to involve the residents in the decision making process, thus denying them their right.
Mbogoli claimed that the 30,000 residents whose houses were set to be demolished had not been provided with alternative housing.
In her ruling, Justice Njoki Mwangi gave the county government 21 days to respond to the application.
"I decline to order for an injunction the applicants wanted but order that they serve the defendant with 21 days before the inter parties is heard," said Justice Mwangi, as quoted by the Standard.
In the project that was launched in April, Joho plans to replace old houses in 10 housing estates namely Khadija, Miritini, Changamwe, Tudor, Mzizima, Buxton, Likoni, Nyerere, Tom Mboya and Kaa Chonjo.
Nyali MP who had attended the court session said he wasn't opposed to the project but however, called for public participation.
