The High Court has dismissed a case in which Kiambu Governor William Kabogo had sought to block Kabete MP Ferdinand Waitutu from contesting for governor.
Justice Joseph Onguto dismissed the case, saying the court does not have jurisdiction over matters that needed to be determined in the case.
“The issue of leadership and integrity is a matter that can be dealt with accordingly by institutions mandated under the law,” said Justice Onguto, as quoted by kbctv.co.ke.
The governor has also been ordered to settle the suit's legal costs.
Kabogo had challenged Waitutu's academic qualifications, saying the MP “does not possess any valid university degree and there is no evidence he went through a process of learning, tutoring and examination.”
He said Waitutu is not suitable to hold public office, claiming he had breached the Leadership and Integrity Act, by lying about his academic credentials when he submitted his self-declaration forms.
Waititu, however, denied the claims.
He argued that he has valid educational qualifications from Punjab University in India.
