Judge Nathan Syundu said Matundura was the duly elected MCA because the election process was free and fair conducted as by the law.

Matundura vied as an Independent candidate during the August 8 poll.The court also ordered the petitioner Fred Nunda who vied on an ODM ticket to pay expenses for the hearing.

Nunda garnered 2,577votes against Matundura’s 2,612 votes.

In the petition, the complainant accused the presiding officer of Mosando primary first stream Fred Kebaya and second stream presiding officer Douglas Makori of rigging against his opponent.
