Senior Resident Magistrate Peter Areri in his ruling said that the petitioner failed to provide evidence proving that Mr. Abdullahi bribed and intimated voters during the August 8 General Election.

The petition had been filed by Mr. Issack Feisal Abdinoor of Jubilee Party who had moved to court seeking to nullify Mr. Abdullahi’s election.

In the case, Mr. Feisal claimed that Mr. Abdullahi bribed voters at three polling stations including, Township Primary School, Village Polytechnic, and Bula Mpya Primary School.

The petitioner alleged that fake rubber stamp was used to mark 183 ballot papers at Geneva White House polling station stream two instead of the official stamp from IEBC.

Mr. Feisal further claimed that he was denied a chance to vote after his registration was transferred to Arda Hagarsu in Mandera North Constituency but he was registered as a voter at Village Polytechnic in Mandera East Constituency.

The petitioner who accused the presiding officers at the stations of being biased claimed that they were relatives of Mr. Abdullahi and that they openly supported the EFP candidate.

Magistrate Areri in his ruling said that the election was conducted in accordance with principles of the constitution.

Justice Areri ordered Mr. Feisal to cater for the cost of the petition which amounts to Sh2 million.
