A Mombasa Court has dismissed a petition challenging the victory of Kwale Governor Salim Mvurya in the August 8 general election.Lady Justice Mugure Thande ruled that the petition was incompetent and did not meet the petition rules.The petition had been filed by a Kwale voter, Mr Mwamlole Mbwana who had moved to court seeking to nullify the governor’s re-election.Mr Mbwana challenged the Kwale gubernatorial results, arguing that the election was not free and fair.Justice Thande further ordered former Kwale gubernatorial candidate Chirau Ali Makwere to cater for the cost of the petition which amounts to Sh2.4 million.The Governor wanted the petition thrown out on grounds that his challenger had failed to enjoin his deputy Fatuma Achani, adding that the petitioner had also failed to state the date of the declaration of the results.Salim Mvurya was re-elected for a second term in office on a Jubilee party ticket after garnering 119,680 votes, trouncing Wiper’s Makwere who garnered 29,741 votes.
