Judge Hellen Omondi while dismissing the petition said it was defective and would waste the court's time.
According to Omondi, the petitioner failed to adhere to the election petition rules.
The judge added that the petitioner breached the election petition Act by filing a defective petition. Lumumba Nyaberi had filed the case.
Nyaberi vied for Kisii governor on August 8 on Wiper Party.
However, Ongwae has to await another petition challenging his victory which was filed by two voters.
