Controversial Nakuru East MP David Gikaria got a reprieve on Wednesday after the court dropped an incitement case against him for lack of evidence.
Gikaria popularly known as 'TM' was charged alongside Biashara Ward representative Stephen Kuria last year after they vehemently opposed the eviction of hawkers from the town centre.
However, the prosecution failed to present witnesses forcing trial magistrate Mary Otieno to drop the charges but with certain conditions.
The Magistrate said that the case could be reopened if the prosecution avails sufficient evidence linking the two suspects to the chaos that rocked the relocation of hawkers.
The two leaders were accused of breaking the main gate to the then Wakulima Market in Nakuru town between June 4 and 6 last year during a standoff between the traders and the County Government officers.
Gikaria and Kuria also faced alternative charges of inciting traders not to pay fees and levies to the County Government due to the negligence and poor conditions of the market.
Kuria had purportedly led more than 100 traders in an exercise of destroying the market gates valued Sh 80, 000.
However, while giving their testimonies, the county government officers said they did not see any of the leaders participate in the said exercise.
The two leaders were charged alongside Daniel Mwangi, Christopher Kimata, George Kangethe and Joseph Kibe.
They had been released on Sh50, 000 bond each with a surety of a similar amount. The other four were each granted free bond.
