The High Court has ruled that school authorities have the power to suspend or expel students when they misbehave.
The court said learning institutions are responsible for bringing up morally upright citizens and therefore school administrators have the authority to uphold discipline in their schools.
The ruling was made following a case where a private school was sued by one of its parent for suspending his daughter who was alleged to have been a bully.
“In my view, the authority of schools and their administrators to impose sanctions, including expulsion, as disciplinary action against erring students,” Judge Chacha Mwita ruled as quoted by the Standard.
“Suspension can only be imposed when all other means of correction fail to bring about proper conduct, or if student presents a danger to people and property or disrupts the educational process for other students,” he added.
