An election petition against National Assembly Majority Leader Aden Duale has taken a different twist after a High Court on Tuesday allowed his arch-rival Farah Maalim read-only access to the KIEMS kits.
According to The Star, Maalim wanted the court to change its earlier ruling on the case, but judge Hedwig Ong’udi maintained that he could only have read-only access to the kits.
The politician is seeking to overturn Duale’s win on the grounds that the election was marred with illegalities and irregularities that saw him lose one of the most watched races at the constituency level.
Maalim has insisted that the outcome of the August General election does not reflect the will of the people of Garissa and he wants the Independent Electoral and Boundaries Commission (IEBC) to call for a fresh exercise as soon as possible.
Duale’s lawyer Issa Mansour has accused Maalim of presenting the court with fake forms 35A in his petition as he seeks to be granted his will ahead of the presidential rerun scheduled to take place on October 26th.
