The Mombasa High Court has halted construction activities on the Standard Gauge Railway (SGR), until it hears and determines a petition that was brought before it.
The complainant, African Gas and Oil Company has faulted the government (Kenya Railways and National Land Commission) for failing to compensate it Sh520 million for 41.2 hectares of land in Miritini.
In her ruling, Lady Justice Ann Omollo, allowed the Chinese Contractor China Road and Bridge Corporation (CRBC) to secure their properties.
"They are however, not allowed to start or carry out any constructions, buildings, excavations or do such other activities that would contravene the order other than what is allowed," read the order in part.
Through Lawyer Micheal Oloo, the oil firm argued that it was advised that the land together with others would be procedurally acquired and compensated.
"The petitioner humbly accepted the award by the 3rd responded (National Land Commission) and supplied details of her bank account to which the money was to be deposited," read the petition by the firm.
The matter will be heard and determined on July 22, 2016.
