The Salaries and Remuneration Commission (SRC) has been stopped by the high Court from effecting the pay cut of Members of County Assemblies until a case by MCA’s challenging the Gazette Notice by SRC reducing the remuneration and benefits for state officers in the County Governments is heard and determined.High Court Judge, Justice Chacha Mwita issued the order on Tuesday after the members of the county assemblies moved to court seeking to stop implementation of the pay cut.The county assembly members argued that the demands of SRC are "unreasonable and ignored relevant considerations."They also argued that the gazette notice issued was “discriminatory, malicious, arbitrary and goes against their legitimate expectations” which affected service delivery in the 47 county governments.According to the SRC the decision continued to curtail the right to entitlement of fair annual salary .The Secretary general for MCA's Society, Mr Eric Mwangi claimed that squashing their allowances is contrary to article 27 of the constitution.The decision of SRC to reduce and abolish the remuneration and benefits of the state officers in county assemblies and retain similar remuneration and benefits of other state officers is discriminatory and contrary to Article 27 of the constitution,” said Eric Mwangi.SRC had done away with the MCAs’ car grants, sitting allowances and reduced other allowances such as mileage.
