The arrest warrant issued by the court early Monday morning against Embakasi East MP Babu Owino has been lifted.
Senior Principal Magistrate Martha Mutuku had issued the orders after Babu together with his bodyguard Fanuel Owino failed to appear for the mention of an assault case they are facing.
The two however showed up at noon and told Magistrate Mutuku that they had been on another case at the Kibera Law Courts when the assault case was being mentioned at the Milimani Law Courts.
In the case, the two are being charged with allegedly assaulting a parking attendant on January 11, this year.
On the material date, the court heard that Babu and his bodyguard attacked Mr David Gichagu at Fortis Plaza in Westlands, Nairobi.
The court heard that the MP and his bodyguard committed the crime with others not before the court.
Babu was separately charged with two other counts of using abusive language and creating disturbance.
The two who pleaded not guilty to charges are out on a personal bond of Sh20,000 each.
A video went viral on social media allegedly showing the MP and his guards roughing up a parking attendant in Westlands.
Babu was arrested by Flying Squad officers outside Parliament buildings after the clip obtained from CCTV footage went viral showing a group of men alighting from an SUV and beating the parking attendant.
The case will be mentioned on February 19.
