A Kisumu court on Monday annulled the election of Ford Kenya's Philemon Ojuok as the MCA for Central Nyakach Ward.
Kisumu Senior Principal Magistrate Christopher Yalwala noted that the petitioner had provided sufficient evidence to warrant the nullification.
Defending his judgment, the magistrate stated that there were electoral offenses as well as non-compliance with electoral laws during the tallying process.
Some of the offenses identified by the court include; failure to sign all electoral documents by the agents and wrong tallies where the number of votes cast exceeded the total number of registered voters.
The principal magistrate directed the IEBC to conduct a fresh poll in accordance to the constitution.
Ojuok is the second MCA in the county to lose his seat after the election of East Kano/Wawidhi ward re John Kennedy Ageng’o was also nullified.
In the Ageng'o petition, Chief Magistrate Julius Ng’arng’ar ordered for a fresh election in the ward after the court found that the Independent Electoral and Boundaries Commission (IEBC) failed to adhere to the established regulations in the counting and tallying of votes.
