Court of appeal has given a new ruling on the case involving the printing of ballot papers for presidential candidates in the upcoming general election.
The five bench judge that has been listening to the case since early hours of today, has given the much awaited ruling by the both NASA and Independent Electoral and Boundaries Commission (IEBC).
NASA had gone to high court to prevent the Al Ghurair company from printing the presidential ballot papers due to allegations of mistrust and unconstitutional awarding of tender.
The high court led by Judge Odunga gave it's verdict in nullfying the tender and ordered the IEBC to begin a fresh amid claims from the NASA coalition.
It was then that IEBC decided to appeal the case after much pressure.
The court of appeal thus gave it's verdict which allowed the Al Ghurair company to continue the process of printing ballot papers for presidential candidates on the basis that NASAs argument was bias.
It futher stated that direct procurement is constitutional and public participation is not mandatory.
This is a major setback to the NASA party who have been in the frontline opposing the tender.
