Kisii High Court magistrate Judicaster Nthuku said that the reasons tabled before the court by the wives of the deceased Catherine Nyang'ate and Biliah Nyang'ate were enough reason to reorder the burial of the man.

"As per the argument of the wives of the deceased I order exhumation of the body of Mr Nyang'ate from Borabu area and he be buried at Bonchari area in the next 24 hours," she said.

The two women had filed their case through lawyer Eliud Moturi and demanded their sons be stopped from burrying the man at Borabu but at his ancestral home as per to his demands.

According to the women it was a taboo as per to the community's culture to bury a married man who has sired kids out of wedlock away from his ancestral home.

They faulted their sons for making the decision.
