A Mombasa Court has adjourned a case against a man accused of being a member of the al-Shabaab militia group, to allow him undergo surgery.
State prosecutor Eugene Wangila on Tuesday filed the application to have the case postponed, after one of the suspect in the terror case developed complications.
Prosecutor Wangila asked Senior Principal Magistrate Diana Mochache to enable Mr Salim Mbaruku to undergo surgery.
The prosecutor told the court that the accused had developed complications and was unable to attend the hearing of his case.
“We are ready to proceed with the hearing of the case but we have been informed that one of the suspects has developed a hind limb problem and is unable to walk,” said Mr Wangila.
Mr Mbaruku was charged jointly with Mr Abdulrahman Babu and Mr Said Abdalla with being members of the al-Shabaab terrorist group.
The court heard that the three accused persons were arrested on June 18, 2016, at Mukunumbi Shopping Centre in Lamu West Sub-County.
The three faced an alternative charge of holding a meeting to plan how to carry out terror activities in the country, together with others not present in court.
The case will be mentioned on August 23, 2016.
