A Mombasa Court has ruled that it has jurisdiction to hear a corruption case against Lamu West MP Julius Ndegwa.

Ndegwa had filed an application to have the case transferred saying the prosecution was wrong to file the case in Mombasa.

In the case, Ndegwa and six members of the Constituency Development Fund (CDF) board are being accused of allegedly transferring Sh1.67 million to the CDF Office’s account fraudulently between July and October 2013.

The accused persons were also facing charges of irregularly reallocating and misappropriating the funds.

The six board members are Michael Thengeru, Yussuf Hassan, Zakayo Gitonga, Cornel Tuva, Sophia Wanjiru and Alfred Mnjaema.

MP Ndegwa through his lawyer Mr Danson Mungatana in their application wanted the court to drop the case arguing that the case was registered in a wrong court.

Lawyer Mungatana asked the court to transfer the case to a court in Lamu County where the offence was allegedly committed.

Mombasa Chief Magistrate Julius Nang’ea in his ruling dismissed the transfer application saying the court has jurisdiction to handle the case.

“The court has powers and jurisdiction appointed to it by the Chief Justice to hear and determine the anti-corruption case,” ruled magistrate Nang’ea.

The case will be heard on March 31.
