The High court has ordered the County Government of Nyamira to reinstate a County Secretary it had recently relieved from duty.
The devolved unit through its Deputy Governor Amos Nyaribo on May 10 issued a letter of termination of contract to Vincent Amao who also serves as the Head of Public Service.
In protest to the move, Amao, rushed to the Employment and Labour Court which granted him reprieve buy ruling this termination from office was unfair and never followed the due process.
“Pending the hearing of the matter, the court has granted an interim conservatory order to protect the status of the current County Secretary and barred the respondents jointly and severally from commencing any dismissal or termination of the contract without due process of law,” stated Justice Nduma Nderi.
Justice Nderi also found the County Government to be in contempt of court and granted leave for Amao to prosecute the County of Nyamira, County Public Service Secretary, and the County Public Service Board.
Amao’s advocate, Wilkins Ochoki, stated that on November 20 last year, his client and the county government of Nyamira entered into a contract signed in court that directed that the devolved unit continues recruiting other County officials but spare eight Chief Officers and one County Secretary.
“Despite the Consent Order, the county government went ahead and offered a termination letter to my client without following the due process. This actions are malicious and are aimed at edging him out of employment permanently with no reason given,” stated Achoki.
Justice Nderi ordered the county government to provide a response in two weeks pending a hearing of the case on July 3.
