Three  MCA’s suspended from the Kisumu County Assembly have breathed a sigh of relief after the high court reinstated them back to the local legislative house.

Seth Olale(Nyalenda B), Jacktone Ogendo (Nyalenda A) and Joachim Okech (Kondele) had moved to court in protest of speaker Onyango Oloo’s decision to throw them out for three weeks claiming they had portrayed ‘unruly behaviour’.

Through their advocate Kenneth Amondi, the trio asked Justice David Majanja to overrule the speaker’s decision pending hearing and determination of the case.

They told the court that speaker Oloo had overreacted and acted beyond his mandate and had also violated the constitution.

Justice Majanja directed that the matter will be heard on April 19.

Last week, Kisumu County Assembly Speaker Onyango Oloo ruled that Olale will miss 14 sittings, while and Oketch were suspended for a period of 21 days each.

“Mr. Jackton Ogendo Ojwang, Mr. Joachim Omieno Oketch and Mr. Joseph Olale violated the laws governing proper conduct of the assembly matters. They refused, declined and persisted in their violation of the standing orders of this assembly,” said the Speaker.

The Speaker said that Mr. Ogendo and Mr. Oketch received the 21 days suspension, because they had broken the Assembly’s rules more than once in the same sitting.

“As for Jackton Ogendo Ojwang and Joachim Oketch, this being the second such misbehavior within the same sitting, I do suspend them from the assembly for a maximum of 21 days each. And so ordered accordingly,” ruled the speaker.
