Kisii High court on Wednesday rejected a plea to withdraw a petition challenging the election of Kisii governor James Ongwae.
Judge Hellen Omondi said the application by Lumumba Nyaberi, through his lawyer Sonye Ondari will be heard on November 29 after the court deputy registrar issues a notice on the matter and serves the interested parties.
Onderi told the court that Nyaberi, the third petitioner in the poll petition wished to drop the petition and had advertised it in local media on November 11, urging the court to accept.
First petitioner Joel Onsando and second petitioner Francis Omao objected the plea through their lawyer Edward Begi.
Begi argued that his clients will be prejudiced and asked the court registrar to issue the notice for the application hearing before Nyaberi withdraws.
Justice Omondi ruled that the petitions filed by Onsando and Omao against IEBC, area returning officer and governor Ongwae among others will proceed.
