A Nairobi court has barred the prosecution from using a proxy witness to present video clips evidence in a case in which Kabete MP Ferdinand Waititu is accused of incitement to violence.

Milimani senior principal magistrate Joyce Gandani forbid the prosecution from using another witness to produce video clips in a case where the Kabete legislator is accused of inciting Kayole residents leading to violence. 

The prosecution had informed the court that the protected witness and a forensic expert could not be traced. The expert had earlier testified and produced video clips concerning an incident where the MP is alleged to have incited Kayole residents. The prosecution applied for another witness to testify on behalf of the expert, but Waititu objected. 

Waititu is charged with uttering words that the prosecution says led to the deaths of two people in Kayole estate in 2012 while he was MP for Embakasi.

He has since denied inciting people to violence and is out on a cash bail of Sh100,000.
