A court in Mombasa on Friday ruled in favor of newly-elected Anglican Church of Kenya (ACK) bishop.  

According to The Star, the consecration of consecration of Alphonse Mwaro as the new bishop will continue on Sunday as planned after a section of clerics opposed to his election lost the bid to stop the ceremony. 

In his ruling, senior principal magistrate Martin Rabera dismissed the application, citing lack of merit.

This is after Mombasa Memorial Cathedral administrative secretary George Kuza, Tom Dawa and Emmanuel Wanje filed a case opposing the election of the new bishop.  

The disgruntled clerics argued that his election does not reflect the will of the members of the church.

The clerics told the court that the exercise was marred by illegalities and irregularities. 

Through their lawyer Wandai Matheka, the clerics sought for legal redress, claiming lack of freeness and fairness in the exercise.

They also said that their effort to resolve the matter at the church level proved futile. 

Rabere said that the members of the church will suffer more if he grants the wish of the clerics opposed to the consecration. 

He further said that there will be a power vacuum if the issue is not resolved with immediate effect. 

He reminded the clerics that they would have considered to all church constitutional channels before filing a case in court.
