A Kakamega court has ruled that Senator Bonny Khalwale has a case to answer for participating in Cord's anti-IEBC protests two weeks ago.
The senator was charged along side his bodyguard Washington Mzozo.
In his ruling on Friday, Kakamega Senior Principal Magistrate Samuel Wahome said the two will be charged with rioting after a proclamation, contrary to Section 83 of the Penal Code.
The two accused, through their lawyers Moses Wetangula and Calistus Shifwoka, had appealed to the court to dismiss the case due to lack of sufficient evidence.
Speaking in a press briefing after the ruling, Wetangula accused the government of trying to silence leaders who have been vocal over the IEBC issue.
The two will take a plea on June 10, 2016.
The senator was arrested on May 23, 2016 for taking part in Cord's anti-IEBC protests in Kakamega.
He was later released on a Sh100,000 bond after being arraigned in court.
