A Kisii court has set a date for the ruling on the petition challenging Governor James Ongwae's election.
Justice Hellen Omondi announced February 27, 2018 as the ruling date after both the parties concluded their submissions on Monday.
Voter Makori Onsando had filed a petition to challenge the victory of the governor on August 8, 2017 polls.
The petitioner's lawyer Edward Begi in his submission argued that the elections conducted on August 8, did not comply with the Elections Act.
Mr.Begi said the election process was not transparent, fair and credible.
He pointed out that in Endereti Polling Station, Governor Ongwae scored in form 37A 134 votes, 37B 154, 37C 154 while Chris Obure 37A 137, 37B 113, 37 C 113 votes .
Mr.Begi noted that in Nyachenge Polling Station, Ongwae scored in 37A 163 votes , 37B 163, 37C 163 votes while Obure 37A 213, 37B 133, 37C 133 votes .
"This shows that Ongwae is more advantaged than Obure," Begi said.
IEBC's lawyer Victor Obondi said no agent signed an affidavit before the court to challenge the exercise.
Ongwae 's lawyer Okong'o Omogeni argued that differences in votes was not a sufficient ground to nullify the election.
The counsel stated that submission tabled by the petitioner before the court was contagious since he didn't attach copy of the legitimate IEBC register.
