A decision by Nakuru Governor Lee Kinyanjui to send county employees on compulsory leave has been canceled by the Employment and Labor Relations court.
On Thursday, Justice Hellen Wasilwa gave her ruling nullifying Kinyanjui's decision following a petition submitted to the court by the employees.
“The decision to send the petitioners on compulsory leave was made without jurisdiction and is wrong in every respect as none of the petitioners was ever notified of any complaints or allegations against them that could trigger such drastic action,” reads the affidavit in part as quoted by The Standard.
According to reports the 115 administrators submitted their petition to the court on Wednesday challenging Kinyanjui's decision.
The follows Governor Kinyanjui decision to send them on leave on Monday. Kinyanjui justified the move stating it was a way for him to restructure devolved unit.
