A court in Mwingi has summoned Dadaab refugee camp manager Jeremiah Ng'ang'a to explain why he disobeyed orders to admit 29 refugees.
The 29 were arrested on March 14 along the Mwingi-Garissa highway inside a lorry ferrying maize.
The refugees were suffocating at the time they were rescued and were taken to court and each fined Sh50,000.
The court ordered they be returned to Dadaab, but Ng'ang'a denied them admission saying they were not registered with the camp.
He argued that the database for refugees showed some of their documents had expired and could therefore not be admitted to the camp.
He also said there was no need to admit them as the camp was set for closure. The refugees have been staying at Mwingi police station until April 4, when UN officials asked the Mwingi court to give the way forward on the case.
Ng'ang'a is expected to appear in court on April 10.
The government, in November 2016 extended the closure of Dadaab by six months to May following a special request by United Nations High Commission for Refugees.
Kenya had vowed to close the camp by November 2016 after accusing some refugees of promoting terrorism.
