A Nairobi Court has ordered former Eldoret South MP Peris Simam to appear in court over allegations of fraudulently obtaining money.

Milimani Senior Principal Magistrate Kennedy Cheruiyot issued the order after Simam failed to appear in court on Monday to plead to the fraud charges against her.The magistrate issued the order after the prosecution informed the court that the accused was not present as required to take a plea.Simam’s lawyer Katwa Kigen told the court that her client was unwell and could not appear in court.Magistrate Cheruiyot also ordered Simam to present her medical documents showing why she failed to appear in court.The former MP is accused of fraudulently obtaining Sh3 million from a Ministry of Health employee, Cosmas Mugambi, by lying she could sell him a house and land worth Sh18 million in Madaraka estate.The court heard that Mugambi paid the Sh3 million as down payment and was to deposit the balance of Sh15 million to Simam’s Kenya Commercial Bank account through the Civil Servants Mortgage Scheme.Simam is alleged to have committed the offence in Nairobi between May 26 and June 12, 2017.Last year, Simam and her husband Enock Kimeli were ordered by an Eldoret Court to pay a fine of more than Sh10 million or be jailed 20 years after the court found them guilty of 10 counts of corruption.The case will be heard on September 28, 2017.
