Two Nakuru County top police officers have been summoned to court to explain how a junior colleague facing defilement charges got his job back before the court cleared him.
Nakuru Regional Administration Police (AP) commandant Mr Francis Kirathe and the District Criminal Investigation Officer (DCIO) Mr James Leila were directed by Resident Magistrate Elizabeth Kelly to appear in court on May 27.
Mr Kirathe was also ordered to produce the personal file of Senior Sergeant Philip Maritim so as to assist the investigating officer trace him.
The court was told that Maritim has since disappeared after jumping bail.
He allegedly forged a letter which purportedly came from Nakuru magistrates court indicating that the court had cleared him of the charges of defilement and was therefore free to resume duty.
The prosecution on Wednesday dismissed the letter as a forgery when it was presented in court. The prosecutor requested for more time to investigate the letter with the help of the DCIO.
Despite a warrant of arrest being issued against the accused, he is yet to be arrested.
The prosecutor told the court that Maritim, being a police officer, has been threatening witnesses and is doing his best to sabotage the case.
Maritim was charged with defiling a minor at Kivumbini AP line in Nakuru on November 28, 2013. He also faces an alternative charge of indecent act with a minor. He was released on a Sh50, 000 bond with a surety of a similar amount after he denied the charges but then vanished.
The matter will resume on May 27 when the two top cops appear in court.
