The High Court has suspended a decision by the communications authority to spy over phones of Kenyans ahead of the August 8 polls.

In issuing suspension orders, Justice John Mativoo said that the Communication Authority, will not enforce the decision.

He said this will be the case until a case by activist Okiya Omtatah is heard and determined.

Omtata had moved to court seeking the dismissal of the directive that indicated that the mobile phone monitoring would begin on Tuesday.

He stated that the authority's arbitrary decision to spy on Kenyans violated both the law and the constitution.
