The Mombasa High Court on Wednesday suspended an order requiring Kenya Ports Authority (KPA) acting managing director Catherine Muturi to appear in court over contempt.

Justice Anyara Emukule made the ruling following an application by the ports authority under a certificate of urgency seeking to stop the order.

Ms Muturi, had been summoned by the High Court two weeks ago to explain why she should not be committed to civil jail for contempt.

Justice Emukule ruled that Ms Muturi should appear in court to explain why KPA did not comply with an order requiring it to nominate Portside Freight Terminal Limited, a company associated with the family of Governor Hassan Joho to handle freight.

In the case, the ports authority had earlier been temporarily barred from implementing its decision to suspend nomination of containers to the freight station.

In January, the court had ordered to put on hold the port’s decision to suspend the nomination of containers to Portside Freight Terminal.

The authority through its lawyer, Mr Billy Kongere, in their application on Wednesday argued that the ports authority has already engaged in negotiations with the freight station to find a lasting solution to the problem.

Lawyer Kongere further said that the ports authority was complying with the order therefore there was no need to bring Ms Muturi to court.

The case will be mentioned on July 11, 2016.
