The High Court on Thursday temporarily halted the arrest of NYS former deputy director general Adan Harakhe and former chair of the ministerial tender committee Hassan Noor in line with the Sh1.6 billion scandal at the service.
The two had filed an application to bar the DPP's office from authorising or pressing criminal charges against them.
Through their lawyer Roger Sagana, the two requested for temporary reprieve on grounds that they were apprehensive that the Public Prosecution office would order for their plea-taking today.
The lawyer added that his clients had received summons to appear before the Ethics and Anti-Corruption Commission on Thursday so as to record their statements on the matter.
