The Mombasa High Court has quashed a defamation case facing Coast Regional Coordinator Nelson Marwa.
Governor Hassan Joho's ally Aharub Ebrahim Khatri had accused Marwa of making defamatory remarks against him after he was arrested over drug trafficking and illegal possession of firearm claims. Khatri had alleged that Marwa was attempting to use him as a sacrificial lamb at the expense of certain politicians whom he did not mention.He also claimed that his life was in danger following the remarks made by Marwa. Khatri climed that Marwa and other security officers called for a press conference on the January 14 and made defamatory remarks against him. In her ruling, Lady Justice Njoki Ndung’u ruled that Marwa and the two security officers were on official duty since they appeared wearing uniforms during the said press conference. Justice Ndung’u ordered the complainant to file a lawsuit against the office of Attorney General after making amendments on the plaint.
