Former Lugari MP Cyrus Jirongo is now a happy man after High Court quashed the decision by the Director of Public Prosecutions to compel him face charges over Sh50 million land fraud.

High Court Judge George Odunga, who was presiding over the case said it will be unjust to prosecute the former MP for a crime that was committed over 20 years ago.

Jirongo had been taken to court for giving false information linking Jonathan Moi to the crime that allegedly took place between in early 90s.

The politician was also asked to respond to accusations that he had induced Post Bank Credit officers to accept the bank charges on September 25, 1992 for a piece of land that he had registered under the name of Soy Developers.

The court also wanted him to shed more light about claims that he had paid Jonathan Sh7 million towards the purchase of the company as a balance of payment.

Odunga said it amounts to misuse of the court systems to subdue an opponent.

"Use of criminal process to subdue the opponent is misuse of the court process," he said, as quoted by the Star.
