The High Court is set to rule on Thursday whether the election petition challenging Nairobi governor Mike Sonko’s victory should proceed to full hearing or be thrown out.

Presiding judge Msagha Mbogholi on Mondays heard arguments by the Sonko lawyers. 

They urged the court to dismiss the petition and its petitioners.

Sonko's defence team said the petition was defective and that the court ought not to entertain it further. 

The petition was filed by Japheth Muroko and Zacheus Okoth. 

On their part, IEBC have through their lawyer Nani Mungai supported the bid to strike out the petition, arguing that a deputy governor is a critical defendant in a petition. ​

Governor Sonko in an affidavit supporting the application said his election cannot be made separate from that of his deputy.

“I believe that by omitting my Deputy Governor as a respondent, then this court is being invited by the petitioners to act in vain, and it ought not to do so,” he said. 

The petitioners insisted that Igathe is not a necessary party.
