Machakos court today heard the Yatta constituency election petition case filed against the August 8 election of Charles Kilonzo as the Member of Parliament for the electorate.
The former Yatta policymaker Francis Mwangangi could not concede to the shocking defeat from the current MP Charles Kilonzo thus moved on to court in efforts seek nullification of the of the election of Charles Kilonzo.
According to Mwangangi, Yatta’s parliamentary seat poll was characterized by irregularities.
Andrew Makundi, who is the lawyer representing Mwangangi in his submission called on the court to nullify the election of Charles Kilonzo and a fresh poll be ordered.
“There were so many anomalies attached to the election of Mr. Kilonzo and invalidating the poll will be doing justice to the entire Yatta constituency’s people,” said Mwangangi’s lawyer Mr. Makundi.
According to Mwangangi’s lawyer, besides nullifying Mr. Kilonzo’s poll, the MP also be made to pay 2.5 million shillings as fine.
The court is expected to give its determinant judgment on the petition on 19th /01/2018 on Friday in the same court. The judgment will either nullify or uphold based on the backdrop of the presented facts and evidence.
Recently the court nullified the election of Wajir County governor Mohamed Abdi. His Nairobi City County, Kisumu County, and Taita Tavet County counterparts had every reason to smile after petitions against them were struck out.
