A Garissa Court will on Tuesday issue a ruling regarding whether a corruption case involving Dominic Kyenza, a former Garissa Sub-County Commissioner will proceed or will be terminated.

The court hearing is expected to be the final, a fact that has been necessitated by the prosecution's failure to avail witnesses in past court sessions.

Garissa Senior Magistrate, Margret Wachira stated that the prosecution side had failed on four recent occasions to avail witnesses leading to repeated adjournments of the case.

Kyenza and his store clerk, Abdullahi Ahmed were in July 2015 charged in the courts for allegedly stealing relief food meant for vulnerable groups in Garissa county.

Judge Wachira said further postponements of the said case will lead to infringement on the rights of the accused persons.

‘‘This case has been put off five times upon the request of the persecution side. The next hearing will be final,” she said.

Wachira gave Walter Wanyonyi, the Assistant Director of Prosecution until Tuesday to bring the witnesses in the case, failure to which she will deliver her ruling to have the case withdrawn.

Cyprian Onono, the lawyer to the accused told the court to cancel the case issuing that the prosecution had shown unwillingness to call witnesses.
