High Court Judge George Odunga will on December 16 deliver his ruling in a case in which Mombasa Governor Ali Hassan Joho has sued Interior Cabinet Secretary Joseph Nkaissery over revocation of his firearms.
According to citizentv.co.ke, Judge Odunga set the date after the parties in the matter made their final submissions.
Meanwhile, the court has extended orders stopping the arrest or withdrawal of Joho’s firearms.
The Governor argues that Nkaissery had no powers to order the revocation of his firearm licences.
He further argued that the minister cannot order the withdrawal of firearms.
“The Firearms Act which gave the Inspector General of Police powers to appoint licensing officers was repealed and a licensing board put in its place for certification, issuance and termination of firearms,” argued Joho as quoted by citizentv.co.ke.
But Nkaissery has asked the court to dismiss the case arguing that it lacks merit.
Judge Odunga while issuing temporary orders stopping the arrest of Joho in March said the power to cancel his firearm licences lie with the licensing board and not with the minister.
