A graft case involving eight Kilifi County officials and the acting health chief officer has been moved to Nairobi.
According to Malindi Resident Judge Said Chitembwe, the case was transferred following a directive by Chief Justice David Maraga.
Chitembwe stated that the case had to be moved to the capital city since it involves the loss of public funds.
“Although the accused have not been charged with corruption offenses, the matter involves loss of public funds and the Ethics and Anti-Corruption Commission (EACC) has been referred as an interested party,” said Chitembwe, as quoted by Nation.
The suspects were taken to court after their passwords were allegedly used in defrauding the county Sh51 million.
The move comes after Senior Prosecution Counsel David Fedha raised concerns over the court issuing two contradictory orders.
“The case has come for direction after orders were given to confirm that the petitioner may proceed with taking plea and bond terms only to realise on December 20 that another order was issued that stayed the previous order,” added Justice Chitembwe.
The suspects include Lenox Mwadzoya, Paul Mwazo, John Kalume, Josephine Muramba, Johnson Nyamawi Gambi, Timothy Malingi, Dickson Tembo and Jacob Konde.
