Kisii Law Court has dismissed a petition challenging Mr James Gisore the Bogetenga ward representative win.
Senior Resident Margistrate SK Njoroge also ordered the petitioner to pay a total of Sh 500,000.
The money will be shared equally amongst the electoral agency IEBC and Mr Gisore.
The petition was thrown out on grounds that the petitioner never produced enough evidence in court.
The Margistrate also said argument that petitioners were chased from polling stations did not add up.
The petition has been filed by Samuel mauti to challenge the victory of mr Gisore.
Im his petition he also accused Gisore for campaigning after the election time was over.
He also alleged that on the voting day illeterate voters were asked to vote in favor of Gisore.
