Kisii High Court on Tuesday afternoon upheld the election of Kitutu Chache North MP Jimmy Angwenyi.
Justice Hellen Omondi stated that the petitioner didn't produce enough evidence in the case.
Judge Omondi, in her ruling said that Mr Angwenyi was duly elected as the MP of Kitutu Chache North.
Ms Omondi ordered the petitioner to pay the three respondents in the case Sh 1 million each.
The judge further said that the August 8, 2017 poll was free and fair
The petition was filed by Mr Robert Ndemo.
In his petition, Mr Ndemo said that the election was not conducted fairly.
He also wanted the court to order for the recount of votes.
Argument that there was massive voter bribery during the exercise did not see Mr Ndemo's case go through.
During the election, Mr Angwenyi won after accumulating 16,121 votes against Mr Julius Migosi who was second with 6,786 votes.
