Justice James Wakiaga in his ruling said that MP Kassim was elected in a free and fair manner adding that the petition lacked merit.

Justice Wakiaga further ruled that the petitioner failed to prove that voters during the August 8 General Election were misled and that technology failed.

The petition had been filed by Mr Mohamud Abbas who had moved to court seeking to nullify Mr Kassim’s election who won on a Wiper ticket.

Mr Abbas in his petition claimed that the Independent Electoral and Boundaries Commission (IEBC) officials using the KIEMS kits during the general elections were not familiar with their operations.

Mr Abbas further alleged that the results were announced without forms from six polling stations adding that voting went on after the official hours and that residents were allowed to vote without IDs or passports.

Speaking after the ruling the MP thanked his constituents for their support and extended an olive branch to Kassim.

"I extend a message of working relationship with my brother Hon. Abass Shiekh who I have huge respect for and inshallah we will work together in ensuring no community is left behind for the betterment of Wajir East Constituency," he stated.
