A High Court sitting in Eldoret has upheld Trans Nzoia senator Michael Mbito’s win in the August 8, 2017, general elections.

Justice Kanyi Kimondo while dismissing an election petition filed by the former senator Henry Ole Ndiema said the election for Trans Nzoia senatorial seat was largely free and fair.

Ole Ndiema had argued that there were massive illegalities and irregularities that tainted the overall outcome of the Senatorial election.

However, in his ruling, Justice Kimondo admitted that there were errors in the results but said the errors could not affect the final outcome of the closely contested race.

“The anomalies pointed out in the court by the petitioner do not substantially affect the numbers or the final outcome of the results,” said Justice Kimondo in his ruling.

“The election was conducted in accordance with the constitution and in my view, the third responded was validly elected as the Senator of Trans Nzoia,” Kimondo added.

The former Senator who vied on a Ford Kenya party ticket is required to pay Sh3 million as costs for the case.

Speaking after the ruling, Ole Ndima said he doesn’t agree with the courts' decision and was consulting with his lawyers before he decides on the next course of action.
