The Kisumu High Court has ordered parties seeking to be enjoined in the Samantha Pendo inquest to consult and record a formal statement with the State Council.
Resident Magistrate Beryl Omollo issued the directive after activist Audi Ogada applied to be enjoined in the inquest.
The magistrate, however, noted that it was imperative for Ogada among other parties yet to be listened to in the inquiry to understand that the sessions were only inquiries seeking to establish whether the respondents had any charges to answer.
“After these sessions, the court will come to a conclusion to find if there are people who should be charged. If it is found that your statements have weight in the case, then we could call you to testify as one of the witnesses in the case,” stated Omollo.
She directed that the hearing be done on Monday 19th.
The inquest begun after after an inquiry file was opened one month ago at the court following orders by former Director of Public Prosecutions (DPP) Keriako Tobiko that a probe into the death be staged to establish the truth.
The probe involves 21 people that include; County Commander Titus Yoma, OCPD Mutume Maweu, OCS John Thiringi and Nyalenda OCS Linah Kosgei.
The security bosses were in charge of deployment of security agents who were suppressing demonstrating youths.
Samantha’s parents; Joseph Abanja and Lenser Achieng have also been listed to testify in the case as civilians.
